Court Date

The mail has come.

The three violations have been combined, and jury selection will be done on the evening of February 16, 2010. A Tuesday.

The following day will be independence day.

I am submitting motions for the disclosure of dashcam video and some 911 information.

I have yet to secure a court date for my Ellis County arrest. The court where I have been ordered to appear has not yet found a record of my violation. That is a fact, anything else is speculation.

All the above will consume much of my attention, but as SteveA pointed out, it is more important to me than it is for them.

  2. I'm getting the sense that you've not consulted a lawyer. Combining the three cases means you have to address the issue of why you, in particular, are such an anomaly... getting three violation in such a short time period. The jury will be predisposed against you already just because you're a bicyclist; add 3 different citations to that and you've got quite the challenge. Please, please use an expert witness.

  4. Chip,

Principled Pragmatist is right "use an expert witness." Here is list Texas LCI within 50 miles of Ennis:

A Northern Ohio cyclist who represented himself asked an local LCI testify as an "expert witness", happily the citation was dismissed.

There's a video of riding a bicycle on the highway and a video about making twisted news stories.

  6. Why is Anonymous posting a link to my website? Odd.

  7. Best of luck... although if it was me in your position... I wouldn't trust a jury to make the right decision.

  8. Chip - contact Gail Spann about this. She's been an expert witness before, and she is also on the board of the League of American Bicyclists. Please, please call her. She lives in Rockwall.

  9. From the John Water’s film Pink Flamingo’s

    Now, Mama,
    that's just egg paranoia.

I think you're being very silly.

    There will always be chickens.

    Why, there are
    so many chickens now...

    that we can eat some
and let some of them live...

I took the train today for a bit of a bike/cheeseburger/Guinness run. I found out that people not only freak out behind you on the road but also on the train. Why are people in such a hurry? Just like on the road where they start their little OMG a bike in the road thing, they were also whimpering behind me on the train exit. We are all getting off the train, the train is not going to leave until we all get off and there are plenty of eggs for all of us…gees. I guess they relate a bike to slow movement wherever they see one. The train passengers were doing everything they could to get upstream from me. Slow down, relax and how could you be in hurry on public transportation?
I guess I could have received a ticket for impeding traffic on a DART train if individual perception was the law.
